STUDENT MISCONDUCT

(for allegations reported after 13 July 2026)

 

Student Misconduct Rules 2026

From 13 July 2026, the University combined the previous Academic Misconduct and General Misconduct procedures into a single process called the Student Misconduct Rules 2026.

If you received an academic misconduct allegation which was reported before 13 July 2026, please refer to the previous Academic Misconduct webpage.

 

What is Student Misconduct?

 

Student misconduct includes:

 
  • Academic misconduct: conduct that breaches academic integrity requirements, such as plagiarism, collusion, contract cheating, or other dishonest academic practices.
  • General misconduct: behaviour that breaches the University's standards of conduct or community expectations.
  • Academic record fraud: falsifying an academic record

 

What is the process for an allegation of Student Misconduct?

 

1. Allegation Reported

A staff member reasonably suspects that a student has engaged in student misconduct and reports the matter to the Office of the Academic Registrar.

 

2. Preliminary Investigation

An Inquiry Officer conducts a preliminary investigation and prepares a report for an Authorised Officer.

 

3. Consideration by the Authorised Officer

The Authorised Officer reviews the allegation and the Inquiry Officer's report and may:

a. Dismiss the matter;
b. Issue a Warning; or
c. Commence either a Pathway 1 or Pathway 2 process.

 

Pathway 1 Process

The student is provided with an allegation and proposed determination and any proposed Category 1 penalty/ies.

The student has 7 days to respond by accepting or rejecting the proposed determination.

If the student does not respond within 7 days, the determination is taken to be accepted and the matter is finalised.

If the student rejects the proposed determination, the authorised officer considers their response and may:

  1. Dismiss the matter;
  2. Issue a Warning;
  3. Proceed with the proposed Category 1 penalty/ies; or
  4. Refer the matter to the Pathway 2 process.

 

Pathway 2 Process

The student is provided with an allegation, any relevant documentation, and information about the range of possible penalties.

The student has 7 days to respond to the allegation.

The Inquiry Officer prepares a report, which is referred to a Student Conduct Panel.

The Student Conduct Panel consists of:

  • A Chair appointed by the Academic Registrar;
  • A staff member; and
  • A student representative.

The Panel may:

  1. Dismiss the matter;
  2. Issue a Warning;
  3. Issue any one or more Category 1 or Category 2 penalties.

How do I appeal?

 

Appeals

A student may appeal:

  • A Pathway 1 decision or penalty within 7 days; or
  • A Pathway 2 decision or penalty within 14 days.

Grounds for Appeal

You cannot appeal simply because you disagree with the outcome. An appeal must be based on one or more of the following reasons:

  • The decision was made without the student being given an opportunity to respond;
  • The decision was made without the student being given notice of the case against them;
  • The decision did not comply with a material requirement of the Student Misconduct Rules;
  • The decision was based on a material mistake of fact; or
  • New evidence has become available that:
    • is relevant to the matter;
    • was not previously known or available; and
    • could reasonably be expected to affect the decision.

 

Appeal Hearings

Students may be invited to an appeal hearing conducted by:

  • An Appeal Officer for a Pathway 1 determination; or
  • The Student Conduct Appeal Panel for any other determination.

Students may be accompanied by a support person. Student Assist recommends contacting Student Assist to request support from one of our staff.
